## Legal framework for regional referendums based on the example of Warsaw local referendums in years 2014-2018

#### Abstract

The subject of my thesis is following: „Legal framework for regional referendums based on the example of Warsaw local referendums in years 2014-2018.” The aim of my work was to know how the legal institution of local referendum works, explaining exactly the processes connected with the conduction such processes and then the analysis some specific referendums what will help in the understanding of this form of voting. I supposed in my work, that the proceeding the local referendum is a complex process and because of that could be noticed that the initiators of referendum are not able meet all formal requirements according to the detected the validity of the process. That causes the difficulty in the getting the valid voices majority. In the first chapter I was trying to explain the etymology of the word democracy and its meaning and what does referendum mean, I showed also the history of the local referendum birth. Started from the antiquity where the very popular form of governance were reunions and then till the short historic analysis of the polish democracy genesis. The second part of the first chapter demonstrates various types of referendums, which actually taken places in Poland. The second chapter based mostly on the polish law about local referendums from 15th September 2000. This law explains step by step how the process is behind conducting this kind of referendum. The third and the last chapter is dedicated to the methodical part of my thesis. Here based on the founded sources and materials two referendums, which has taken place in the previous governed term of office was described. Based of conducted in Warsaw in years 2014-2018 referendums examples can be found that, that the validity of the referendum depends on many factors. The proceeding of referendum and then the validity proof is a very complex process. The taken under analysis referendums were finished on the different stages. None of them finally took place from different reasons. In the first case the referendum was completed based on the Major of Mazovian voivodeship, the second one comes up with after the resignation from the referendums initiator in the issue of the President of Warsaw recall.
